These Terms of Use (“Terms”) govern your access to and use of the DocuSwift mobile application and any related features or services (collectively, the “Service”). By downloading, accessing, or using DocuSwift, you agree to be bound by these Terms and our Privacy Policy.

These Terms constitute a legally binding agreement between you and DocuSwift regarding your use of the Service.

2. Eligibility and Acceptance

You represent and warrant that you have the legal capacity to enter into these Terms and to use the Service in accordance with all applicable laws and regulations.

If you are a child or minor under the laws of your jurisdiction, you may use DocuSwift only with the consent and supervision of a parent or legal guardian where required by applicable law.

You are responsible for ensuring that your use of DocuSwift complies with all applicable laws, regulations, and third-party rights.

3. License to Use DocuSwift

Subject to your compliance with these Terms, DocuSwift grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and use the Service for your personal or internal business purposes.

This license is granted solely for your lawful use of the Service and does not transfer ownership of the application or any intellectual property rights to you.

5. Your Documents and Content

You retain all ownership rights to the documents, images, text, and other content that you create, upload, import, or process through DocuSwift (“Your Content”).

By using the Service, you grant DocuSwift a limited, non-exclusive, revocable permission to process Your Content solely for the purpose of providing the features you request, such as document scanning, file conversion, editing, optical character recognition (OCR), and assisted or automated document features.

This permission does not transfer ownership of Your Content to DocuSwift. We do not claim any ownership rights in the documents or materials you process using the Service.

You are solely responsible for ensuring that you have all necessary rights and permissions to use, upload, process, or share Your Content through DocuSwift.

You represent and warrant that Your Content does not violate any applicable law or infringe the intellectual property, privacy, or other rights of any third party.

6. Assisted and Automated Features

DocuSwift may provide assisted or automated document features, including document rewriting, title generation, OCR, file conversion, and other document assistance features where available (“Assisted Features”).

Some Assisted Features may use AI-assisted technologies or third-party processing services to provide the results you request. These features are intended to support productivity and document readability, but outputs may be incomplete, inaccurate, or unsuitable for your particular needs, especially where source documents are unclear, incomplete, handwritten, scanned, password-protected, or formatted in a complex way.

You are solely responsible for reviewing, verifying, and determining the appropriateness of any output before relying on it, sharing it, or using it for legal, financial, business, academic, or other important purposes.

You agree not to use Assisted Features to create, process, or distribute content that is unlawful, infringes the rights of others, or is intended to facilitate fraudulent, harmful, or deceptive activities.

We may improve, modify, suspend, or discontinue Assisted Features from time to time. Availability and performance may vary depending on your device, operating system, region, language, subscription plan, file type, or technical requirements.

7. Subscription and Purchases

Certain features of DocuSwift may require a paid subscription or other in-app purchase.

All purchases are processed through Apple’s App Store and are subject to Apple’s applicable payment terms and conditions.

Unless otherwise stated, subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date through your Apple ID account settings.

Pricing, subscription plans, trial offers, and available features may vary by region and may change from time to time.

Apple is responsible for processing payments, subscription renewals, refunds (where applicable), and billing information. Questions regarding payment transactions should be directed to Apple.

Failure to pay applicable subscription fees may result in the suspension or limitation of access to premium features.

8. Intellectual Property

The Service, including but not limited to the DocuSwift application, software, user interface, design, graphics, trademarks, logos, text, and other proprietary materials, is owned by or licensed to DocuSwift and is protected by applicable intellectual property and other laws.

Except for the limited license expressly granted under these Terms, nothing in these Terms grants you any ownership or intellectual property rights in the Service.

You may not copy, reproduce, modify, distribute, publicly display, create derivative works from, or otherwise exploit any part of the Service without our prior written permission, except as permitted by applicable law.

“DocuSwift” and related names, logos, and branding are trademarks or service marks of DocuSwift or its licensors. Unauthorized use of these marks is prohibited.

9. Updates and Availability

We are continually improving DocuSwift and may update, modify, add, remove, or discontinue features or functionality at any time, with or without prior notice.

The availability of certain features may vary depending on factors such as your device, operating system, region, language, subscription plan, or technical requirements.

We do not guarantee that every feature will always be available, uninterrupted, or compatible with every device or software version.

From time to time, you may need to install updates to continue using certain features or to maintain the security and performance of the Service.

10. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis to the fullest extent permitted by applicable law.

To the extent permitted by law, DocuSwift disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation.
